Terms of Service

gitmoleads makes tracked QR codes for trucks, signs, and print. Each code is a short link you control: it can open a lead page we host for you, or send people to a web address you choose. The dashboard counts scans, lists the leads your page collects, and sends those leads to you by email.

You must be at least 18 years old and able to enter a binding contract to use the Service. If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to both you and that organization.

You can try the Service without signing up. An account made this way has no email attached and lasts 30 days: after that its codes stop opening your page until you save the account by adding an email. Until then, the account is tied to the browser you used, and, if you arrived from a code we mailed you, to that printed code. Anyone holding that code can open the account until an email is attached, so save the account if you intend to keep it.

Once an email is attached, you sign in with a link we email you, or with a password if you set one. Keep both confidential - you are responsible for activity that happens under your account. Tell us right away at support@gitmoleads.com if you suspect unauthorized access. Account owners and admins control who is a member of their team and what those members can do.

When using the Service, you agree not to:

• break any applicable law or regulation;
• infringe anyone's intellectual-property or privacy rights;
• make a page that impersonates another person or business, or misleads the people who scan it;
• use a lead page to collect payment card numbers, government ID numbers, passwords, or health information;
• point a code at malware, phishing, or content that is illegal where it is viewed;
• probe, disrupt, or circumvent the Service's security or access controls;
• access the Service by automated means (bots, scrapers, scripts) except through features we intentionally provide.

We may disable a code or a page that breaks these rules, without notice where the harm is urgent.

The people who fill in your lead page are your prospective customers. The information they submit - name, phone number, email, message - belongs to you. We store it so we can show it in your dashboard and email it to you. We do not sell it, we do not contact those people, and we do not use it for our own marketing.

You are responsible for how you use it: contact people only about what they asked for, and follow the laws that apply to you, including rules on calls, texts, and email (in the United States, the TCPA and CAN-SPAM). If one of your customers asks us to remove their information, we may remove it and will tell you.

The Service is free today. If we introduce paid plans, we will tell you before anything is charged, and nothing you already use will start costing money without your agreement.

To keep the Service fast for everyone, we limit how quickly accounts, pages, form submissions, and sign-in emails can be created from one connection. We may adjust these limits to prevent abuse. Circumventing them is a violation of these Terms and grounds for suspension.

You keep ownership of the content you submit to the Service - business names, headlines, page text, and similar material. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and process that content solely to operate, support, and improve the Service. You are responsible for having the rights to the content you submit.

The Service - including the site, the dashboard, the page templates, and our trademarks - belongs to GITMO LLC and its licensors. These Terms don't grant you any right to use our branding or to copy, resell, or create derivative works of the Service, except as needed to use it as intended. The QR images you download are yours to print wherever you like.

Codes can point at third-party websites, and the Service relies on third-party providers for hosting and email. Those services have their own terms and privacy practices, which we don't control and aren't responsible for.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied - including fitness for a particular purpose and non-infringement. We don't promise any particular number of scans, leads, or jobs. A printed code depends on the Service being available; plan for occasional downtime.

To the fullest extent permitted by law, GITMO LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose and one hundred US dollars.

You can stop using the Service or ask us to delete your account at any time. We may suspend or terminate access to the Service if you violate these Terms, create risk or legal exposure for us, or if we discontinue the Service. If we discontinue it, we will give account holders reasonable notice so printed codes can be replaced. Sections that by their nature should survive termination (including Sections 5, 8, 9, and 11) survive.

We may change the Service or these Terms as the product evolves. If we make material changes to the Terms, we'll update the effective date above and, for significant changes, notify account holders by email or in the dashboard. Continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Knox County, Tennessee, and you consent to their jurisdiction.
